1. About these terms
These terms apply to enquiries, callouts, assessments, maintenance and quoted works supplied by Altruism NSW Pty Ltd (ABN 32 659 743 781), NSW Electrical Contractor Licence 385443C ("Altruism NSW", "we", "us" or "our").
Any written quotation, scope, booking confirmation or project-specific terms form part of the agreement. If there is an inconsistency, the project-specific written terms take priority to the extent of that inconsistency.
2. Services and scope
We specialise in fault diagnosis, repair, maintenance, fan and motor replacement, VFD and control work, airflow testing, inspections, and upgrades or rectification of existing commercial kitchen ventilation systems.
Unless expressly included in a written quotation, our service does not include:
- new commercial kitchen ventilation installations;
- canopy, filter or duct cleaning;
- building, fire-engineering, mechanical-design or certification services;
- access equipment, roof works, asbestos work, fire-system work or making good; or
- work outside the written scope.
An inspection or assessment records conditions reasonably observable at the time. It is not a guarantee that concealed, intermittent or unrelated faults do not exist.
3. Callout and assessment charges
Unless a different price is confirmed in writing, the following fees apply. All prices exclude GST.
| Service period | Callout fee | Included | Additional labour |
|---|---|---|---|
| Monday–Friday 7:00 am–5:00 pm and Saturday 7:00 am–12:00 pm | $275 + GST | Diagnosis and first hour of labour | $145 + GST per hour |
| Monday–Friday after 5:00 pm and Saturday after 12:00 pm | $400 + GST | Diagnosis and first hour of labour | $215 + GST per hour |
| Sunday and public holidays | $650 + GST | Diagnosis and first hour of labour | $290 + GST per hour |
A multi-fan existing-system upgrade or rectification assessment with written report is $450 + GST unless otherwise quoted. Materials, replacement parts, specialist subcontractors, travel outside the stated service area and work beyond the included first hour are charged separately where applicable.
A callout or assessment fee may be waived or credited when approved remedial or replacement works proceed, where confirmed in our quotation or booking correspondence.
4. Bookings, access and customer responsibilities
- A booking is confirmed only when we accept it and confirm the attendance window.
- Attendance times are estimates and may change because of emergency work, access, traffic, safety or conditions outside our control.
- You must provide safe and lawful access to the site, equipment, switchboards, roofs and work areas, including any required inductions, permits and shutdown approvals.
- You must tell us about known hazards, asbestos, restricted access, fire-system interfaces, operational constraints and relevant prior work.
- You must have authority to request the work or obtain the property owner's approval.
We may suspend or refuse work where access is unsafe, information is incomplete, required approvals are missing or the requested work would be unlawful or outside our competence or licence.
5. Quotes, variations and payment
Quotes are based on the information and site conditions available when prepared. Hidden damage, inaccessible components, incorrect existing wiring, contaminated equipment, structural defects or other unforeseen conditions may require a variation.
We will seek approval before performing material work outside the agreed scope, except where immediate action is reasonably required to make the site safe. Unless otherwise agreed in writing, quoted works require a 50% deposit before commencement and the balance is due on completion. Invoices must be paid by their stated due date.
Special-order parts, deposits and costs already incurred may be non-refundable to the extent permitted by law. If a confirmed attendance is cancelled after dispatch or we cannot gain agreed access, reasonable callout and incurred costs may still apply.
6. Existing systems, performance and compliance
Existing ventilation systems often contain work, wear, contamination or design limitations outside our control. Repairing one component does not make the whole system new or certify the entire installation.
Airflow, noise, odour and operational outcomes depend on the complete system and site conditions, including the canopy, ductwork, make-up air, discharge, controls, cooking load, cleaning condition and building interfaces. Any stated performance target applies only where expressly included in writing and depends on the assumptions recorded in the quotation or report.
References to Australian Standards, the NCC or other requirements are general unless we have been specifically engaged to provide a documented assessment. Final regulatory acceptance may require a suitably qualified engineer, certifier, fire-safety practitioner or relevant authority.
7. Warranties and Australian Consumer Law
Manufacturer warranties apply to eligible equipment and parts subject to the manufacturer's conditions. Any workmanship warranty will be stated in the relevant quotation or invoice and does not cover misuse, contamination, inadequate cleaning, incorrect operation, unauthorised modification, supply faults, normal wear, pre-existing defects or failures elsewhere in the system.
Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
8. Liability
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of trade, food loss or business interruption arising from a breakdown, delay or matter outside our reasonable control. Where liability can lawfully be limited, it is limited at our option to resupplying the relevant service or paying the reasonable cost of resupply.
9. Privacy and communications
We handle personal information as described in our Privacy Policy. By submitting a request, you authorise us to contact you about that request by phone, email or SMS. We do not treat an enquiry as consent to unrelated marketing.
10. Governing law and contact
